In France, anyone wishing to work with a Genetically Modified Organisms (GMO) has to submit a specific dossier for which, after review by an expert committee (Haut Conseil des biotechnologies), a licence number is granted.  This licence number is valid for 5 years but must be updated for each new construct or project occurring during the 5-year duration.

To access ESRF beamlines, a valid licence number, or foreign equivalent, will be required in advance, along with an explanation on the construct to be used and expression host.

Techniques for which this regulation applies are:

  • Recombination techniques or processes involving the use of nucleic acids to induce new combinations of genetic material produced by a virus, a bacteria, or outside any living organism but introduced into any expression host in which the sequence of interest or the construct is not available in natural conditions but in which it may be expressed continuously.

  • Techniques involving direct insertion of hereditary material into micro-organisms or organisms even if such material has been prepared outside the micro-organism or organism including macro-injection, micro-injection, macro-encapsulation, micro-encapsulation, electroporation and micro-projectiles use.
  • Cell fusion techniques (even for protoplasts) or making hybrids for which living cells showing new combinations of material are made by methods not occurring naturally.

Techniques or processes for which this regulation does not apply are those:

  • Not requiring nucleic acid recombination or any GMO:

    • In Vitro Fertilisation
    • Natural processes such as conjugaison, transduction, transformation or viral infection
    • Polyploidal induction
  • Not requiring the use of GMOs as parental receiver:
    • mutagenesis
    • cell fusion including protoplasts or any other cell as hybridomas
    • viral infection by viruses or viroids or prions
    • auto cloning based on deletion of sequences followed by insertion of, all or part of, intact or deleted equivalent nucleic acid, with or without any mechanical or enzymatical step performed in advance, into same cell types or similar types from a phylogenetical point of view and able to exchange some genetic material via natural processes but also if the resulting micro-organism can not be responsible for any disease or hazard for humans, animals or plants and used in contained conditions.
